1. Welcome — and who we are

These Terms of Service (“Terms”) are an agreement between you and Pacaville LLC (“Pacaville Pals,” “we,” “us,” or “our”). They govern your use of pacavillepals.com and any pages, content, or features we offer through it (together, the “Site”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

2. This site is for grown-ups

Pacaville Pals makes entertainment for young children, but this website is intended for adults — parents, grandparents, carers, educators, and business partners. It is not designed or directed to children, and it offers no games, chat, uploads, profiles, or other interactive features for children to use. We do not knowingly collect personal information from children under 13. Any email address, order, or form submission made through the Site must be made by a parent, legal guardian, or other adult aged 18 or over. If you believe a child has given us personal information, contact us at hello@pacavillepals.com and we will delete it promptly. We publish our videos as Made for Kids, and we'd love little ones to watch them in the YouTube Kids app — it's built for young viewers and puts the controls in your hands.

3. What the Site does

The Site provides information about the Pacaville Pals brand, our characters, our animated videos, the real alpacas and llamas the characters are based on, and products we make available. It may link out to services we do not control, including YouTube, our online store, and print or publishing partners. Those services have their own terms and privacy policies, and this agreement does not change them. We may add, change, or remove parts of the Site at any time.

4. Email sign-ups

If you give us your email address, you confirm you are 18 or over and that you are signing up on your own behalf as an adult, parent, guardian, or carer — never on behalf of a child. We will use your address as described in our Privacy Promise. You can unsubscribe at any time using the link in any email we send.

5. Our intellectual property

Everything on the Site is protected. That includes, without limitation: • The names Pacaville Pals, Pacaville Farm, Red Ronnie, Graycee, Wild Winston, Icy Hot, and Dream Bella, and the tagline “Big giggles, little lessons, the whole herd!” • The characters themselves — their designs, appearances, personalities, voices, signature phrases, and signature colors • All artwork, illustrations, animation, video, music, lyrics, sound recordings, photography, text, and page designs • Our logos, wordmarks, and trade dress. These are owned by us or licensed to us, and are protected by copyright, trademark, and other laws. Some marks are the subject of pending or registered trademark applications. You may not copy, reproduce, adapt, translate, distribute, publicly display, sell, or create derivative works from any of it, or use our characters or marks in or on any product, service, event, listing, or promotion, without our prior written permission. You may share links to our pages and videos, and use the official share and embed tools that YouTube provides. We are happy to talk about licensing. Write to us at hello@pacavillepals.com.

6. Fan art and things you send us

We love seeing fan art. But please note: if you send us anything — art, photos, video, messages, story ideas, or suggestions — you grant us a non-exclusive, worldwide, royalty-free, perpetual, transferable, sub-licensable license to use, reproduce, adapt, publish, and display it in connection with Pacaville Pals, in any media, without payment or credit to you. By sending us something, you confirm that: • You are 18 or over • It is your own original work, or you have the right to send it • If a child appears in it, or a child made it, you are that child’s parent or legal guardian and you consent to our use of it • It contains nothing unlawful, harmful, hateful, obscene, or unsuitable for a young audience We are under no obligation to use anything you send, to keep it confidential, or to return it. Please do not send us confidential ideas or anything you expect to be paid for.

7. Rules for using the Site

Please don’t: • Use the Site for anything unlawful, or to harm or attempt to harm anyone, especially a child • Impersonate us, or suggest we endorse, sponsor, or are affiliated with you when we are not • Scrape, crawl, harvest, mine, or bulk-download any part of the Site, or use any part of it to train a machine learning or artificial intelligence model • Interfere with the Site’s operation or security, or try to gain unauthorized access to it • Frame, mirror, or resell the Site or its content We may suspend or block access to the Site at our discretion.

8. Products, orders, and merchandise

Our merchandise and books are sold through our online store. Purchases are governed by the terms, shipping policies, and returns policies presented at checkout on those services, not by these Terms. Product photographs, mockups, and color swatches are illustrative. Printed colors, fabric weights, and finishes may vary between production runs and between screens and physical goods. Where we sell children’s apparel or toys, we do so subject to the applicable safety and labeling requirements for children’s products.

9. Our content is entertainment

Our videos and materials are made for fun and gentle early learning. They are not education, health, developmental, nutritional, veterinary, or professional advice of any kind, and they are not a substitute for it. Content about our real animals describes our own farm practices and should not be taken as animal husbandry guidance. Decisions about what your child watches, and for how long, are yours.

10. Links to other places

The Site links to services we don’t control. We are not responsible for their content, products, policies, or practices, and a link is not an endorsement. Once you leave the Site, these Terms no longer apply.

11. No warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components, or that any information on it is accurate, complete, or current.

12. Limitation of liability

To the fullest extent permitted by law, neither Pacaville LLC nor its owners, members, officers, employees, contractors, or agents will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of the Site — whether based in contract, tort, negligence, strict liability, or otherwise, and even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or relating to the Site or these Terms will not exceed the greater of (a) the total amount you paid us in the twelve months before the claim arose, or (b) one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

13. Indemnity

You agree to indemnify, defend, and hold harmless Pacaville LLC and its owners, members, officers, employees, contractors, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the Site, your breach of these Terms, or anything you send us.

14. Copyright complaints

If you believe material on the Site infringes your copyright, write to hello@pacavillepals.com with: a description of the work, the location of the material on the Site, your contact details, a statement that you believe in good faith the use is unauthorized, a statement that your notice is accurate and that you are the owner or authorized to act for the owner, and your signature.

15. Changes to these Terms

We may update these Terms from time to time. The version posted here with its effective date is the one that applies. Continuing to use the Site after a change means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of laws rules. You and we agree that any dispute will be brought exclusively in the state or federal courts located in Oregon, and we each consent to their jurisdiction.

17. Odds and ends

If any part of these Terms is found unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. These Terms, together with our Privacy Promise (our privacy policy), are the entire agreement between you and us about the Site. You may not transfer your rights under these Terms; we may transfer ours in connection with a merger, acquisition, or sale of assets.
